Terms of Use

1. Eligibility

You must be at least 13 years old (or the minimum age in your region) to use the Services. We collect date of birth during account setup to enforce this rule. By using the Services you confirm that you meet this requirement and that any account information you give us is accurate and up to date. Accounts that do not meet the age requirement may be refused or closed.

2. Your account

• You're responsible for keeping your sign-in methods (email, phone, Google, Apple, etc.) secure and for any activity on your account.
• You can manage your sign-in methods in the app under Settings → Sign-in methods.
• If you sign in with phone or email, you confirm the number/address belongs to you. You must not impersonate another person.
• You can request to delete your account at any time in the app or by emailing hello@fitcoin.co. Deletion is soft-deleted first: your account is flagged for removal and permanently purged after a 30-day grace period. Signing back in during that window cancels deletion. After purge, Auth credentials and associated Fitcoin cloud data are removed subject to backups and legal retention described in the Privacy Policy.

3. FitScore, Fitcoins & rewards

• FitScore and Fitcoins are scoring values calculated from your activity in the main Fitcoin app and, where shown, the same Fitcoin wallet in Sleep by Fitcoin and Pedometer. They are not currency, are not redeemable for cash, and have no monetary value outside the Services.
• Fitcoins can be exchanged for the rewards we offer in the app, subject to availability and any reward-specific rules. Reward catalogues, prices, and partner terms can change at any time. Home companions (pets) and similar virtual items bought or unlocked with Fitcoin are in-app items only: they are not currency, have no cash value and are not transferable outside the Services.
• We may adjust, expire, freeze, or cancel Fitcoins or rewards we believe were earned through abuse, fraud, automation, manipulation of HealthKit/Health Connect/wearable data, or any other violation of these Terms.
• Partner offers are provided by third-party brands. Their fulfilment, returns, and customer-service terms are between you and the partner; Fitcoin is not a party to that contract.
• We may engage contractors to introduce and manage reward partners. Those contractors may be paid a share of partner-related revenue. For that purpose we may share how much was spent at a partner store or on a partner campaign. We do not share your name, account, health data or other personal details with them. 4. Fitcoin Premium

If you subscribe to Fitcoin Premium in the iOS or Android app, payment is processed by Apple via the App Store or Google via Google Play Billing. You can manage and cancel in your App Store or Google Play account settings. If you subscribe on the web at fitcoin.co/premium, payment is processed by Stripe. You can manage or cancel a web subscription through the Stripe customer portal linked from that page. We don't see or store your payment card details. Store and web subscriptions auto-renew unless you cancel at least 24 hours before the end of the current period (or, for a web trial, before the trial ends). UK consumer law also gives a 14-day cooling-off period for distance contracts; starting the trial means the service begins immediately. Premium may unlock features such as advanced AI coaching and insights; availability can change.

You can gift a month or year of Premium to another Fitcoin account (or share a redeemable code). Gifted Premium lasts for the purchased period and does not auto-renew. A Family plan lets one paying owner share Premium with up to five other Fitcoin accounts (six people in total). Family seats are managed in the app; the store subscription stays on the owner's Apple ID or Google account. If the owner cancels or the subscription expires, family members lose Premium unless they have their own subscription, an active gift, or a lifetime grant.

5. Acceptable use

You agree not to:

• Submit fake, automated, or manipulated activity data, or use any device, treadmill, or accessory designed to fake steps/workouts.
• Create multiple accounts to claim referral bonuses, rewards, or raffle entries you wouldn't otherwise be entitled to.
• Reverse-engineer, scrape, copy, or attempt to extract source code or data from the Services.
• Bypass our rate limits, App Check / device attestation, or other anti-abuse measures.
• Use the Services to harass, threaten, defame, or impersonate others, or to share content that's illegal, hateful, pornographic, or otherwise harmful — including in Stories, direct messages, Activity photos, league/club posts and nudges. Ordinary fitness and physique photos in workout or beach attire (for example shirtless gym photos, sportswear or bikini progress pics) are allowed; full nudity and explicit sexual content are not.
• Pump or solicit SMS verification codes for any number you don't personally control.
• Abuse AI coaching quotas or submit unlawful, abusive, or third-party confidential content to coach chat.
• Spam friends with nudges, cheers or messages, or use those features to pressure, bully or impersonate anyone.

We may suspend or terminate accounts that breach these rules, with or without notice, and may report illegal activity to the relevant authorities.

6. Your content

• You keep ownership of the photos, videos, league/club posts, Activity photos, direct-message media and other content you upload ("Your Content").
• To run the features you choose to use, you grant Fitcoin a limited, non-exclusive, royalty-free licence to host, store, and display Your Content to the audience you select — for example, showing your Stories to your friends, your Activity posts and photos to confirmed friends, your chats to the other participant, or your league/club posts to members of that league. We don't use Your Content for advertising, do not sell it, do not sublicense it to third parties, and do not use it to train AI/ML models.
• This licence ends when you delete the content (or your account), except for backups and audit logs that may persist for a short period until they're rotated out. Direct messages are designed to leave the live conversation after about 24 hours, as described in the Privacy Policy.
• You're responsible for Your Content and for having all the rights you need to share it. Workout Activity photos, Stories and chat media must only show people who have agreed to be included.
• We can remove content that breaches these Terms, our community standards, or applicable law.
• Confirmed friends may see your Activity posts (workout type, timing, duration, distance, FitScore earned and any photo you attach) and may cheer, unless you turn off Share workouts in Settings → Privacy. You can remove a workout from Activity or remove its photo. Cheers and nudges are optional social prompts, not medical or performance advice.
• Your public profile may show identity (name, avatar, bio, streak chip, league tier) plus lifetime steps, highest streak and achievements. Confirmed friends can see those stats even if Private profile is on; non-friends cannot. Share FitScore graph hides the profile trend graph but does not hide your FitScore number or remove you from FitScore rankings. Share Energy, Sleep & Recovery controls the vitals rings on your Friends card, league ranking rows and club member lists. Details are in the Privacy Policy.

7. Health, wellness scores & AI coaching

• Fitcoin is a fitness and rewards service, not a medical device. FitScore, SleepScore, Recovery, Energy, Drive, Immune Resilience, Load Forecast, Fitness Age, Heart Health estimates, bedtime suggestions, AI coaching and other insights are wellness estimates for general fitness only. They are not intended to diagnose, treat, cure, or prevent any disease and must not be relied on for medical decisions.
• Sleep by Fitcoin shows a SleepScore and sleep stages from Apple Health sleep analysis. Pedometer by Fitcoin shows steps, live walks or runs, and streaks. Both are wellness / activity tools only.
• Talk to a qualified healthcare professional before starting a new exercise routine, especially if you have any pre-existing condition.
• When you use AI coaching or insight features, selected health-derived metrics may be sent through Fitcoin's servers to our AI processor (currently OpenAI) to generate a response, as described in the Privacy Policy. That can include daily scores, recent workouts, sleep and recovery context, check-ins, and any coach notes or preference files you keep on this device. If you dictate to Coach+, only the transcribed text is sent — not the audio. Do not submit medical records, passwords, payment details or another person's confidential information to coach chat.
• Image and video Stories, and photos or videos sent in direct messages, may be checked by automated safety systems (including our AI processor) before they appear for friends or are delivered. Videos are checked via a small sample of frames. We may allow, refuse (block before upload or send), hide pending review, or later remove content that appears to breach these Terms or our community standards. Automated checks and human reports may create internal moderation records used for safety review.
• You control HealthKit / Health Connect / wearable permissions in each app. Sleep by Fitcoin requests sleep analysis from HealthKit. If you track a night on the phone, it also uses motion and the microphone. Pedometer requests steps, active energy and heart rate, and may use GPS during a live walk or run. Revoking access stops future reads from that source but does not automatically erase data already stored by Fitcoin.
• Optional manual wellness check-ins (such as muscle soreness and mood) are provided for general fitness context only. Mood entries you choose to log are stored securely with your Fitcoin account; we never share or sell this data with any third parties, as described in the Privacy Policy. They are not medical assessments.

8. Intellectual property

The Fitcoin, Sleep by Fitcoin and Pedometer apps, website, brand, designs, and underlying technology are owned by FITCOIN LTD or its licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Services for personal, non-commercial purposes in accordance with these Terms.

9. Third-party services

Fitcoin integrates with third-party services including (without limitation) Apple HealthKit, Apple App Store, Google Health Connect, Google Health / Fit APIs where used as a fallback, Google Play, Google AdMob, Firebase, WHOOP, Oura, OpenAI, our partner brands, and contractors we engage to introduce those partners. Your use of partner brands is also subject to their own terms. We are not responsible for third-party services or content.

10. App Store EULA (iOS)

If you downloaded Fitcoin, Sleep by Fitcoin or Pedometer by Fitcoin from the Apple App Store, you also agree to Apple's Standard EULA: apple.com/legal/internet-services/itunes/dev/stdeula. Apple is a third-party beneficiary of these Terms with respect to that EULA.

11. Disclaimers & limitation of liability

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that scores, insights or AI outputs will be accurate or suitable for any particular purpose.

To the fullest extent permitted by law, FITCOIN LTD, its directors, employees, and partners will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or related to the Services will not exceed the amount you paid us, if any, in the 12 months before the event giving rise to the claim, or £50, whichever is greater. Nothing in these Terms excludes liability that cannot be excluded by law (including for death or personal injury caused by negligence, or for fraud).

12. Termination

You can stop using the Services and delete your account at any time (subject to the grace period in section 2). We can suspend or terminate your access for any reason, including breach of these Terms. Sections that by their nature should survive (e.g. intellectual property, disclaimers, limitation of liability, governing law) will survive termination.

13. Governing law & disputes

These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer law gives you the right to bring proceedings in another jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes we'll update the "Last updated" date and, where appropriate, notify you in the app or by email. Continued use of the Services after the changes take effect means you accept the new Terms.
